Danroy and Angella Henry of Easton, Massachusetts, accepted the offer made by the town of Pleasantville and Officer Aaron Hess, according to a report by WCVB.

The shooting death occurred outside Finnegan's Bar & Grill in Thornwood in the early morning of Oct. 18, 2010 when a police officer knocked on the driver's side window of Henry's car as he was parked in a fire lane.

Police reported Henry then sped off, but Henry's family countered he drove at an appropriate speed and did so in response to the officer's instructions to move.

The family's litigation continues against the town of Mount Pleasant and officers who “failed to respond to grievous gunshot wounds” according to Michael Sussman, the Henry family's attorney.
