Woman Arraigned In DWI Crash That Killed Westchester College Athlete

WHITE PLAINS, N.Y. -- A 24-year-old Rye woman was expected to be arraigned on Monday in connection with the Oct. 9 fatal accident that killed a Manhattanville College lacrosse player.

Robby Schartner, 21, graduated from Brookfield, Conn., High School and lived in Fishkill.

Police said Schartner, a Rye native, was struck and killed by a car driven by Emma Fox, 24, of Rye, who is accused of driving drunk about 5 a.m. a week ago on Sunday.

It appears both college students were leaving downtown White Plains. Fox was driving a 2012 Nissan Sentra. Schartner was walking along Westchester Avenue -- presumably returning to the Manhattanville campus in Purchase -- before sunrise, police said.

Schartner was pronounced dead at the scene after he was hit by Fox's car, police said. The accident occurred near Westchester Avenue's intersection with Anderson Hill Road.

Fox had a blood-alcohol content more than double the legal limit, according to police.  She was charged with first-degree vehicular manslaughter and aggravated DWI.

Robert Wolf, a spokesman for the Westchester County District Attorney's Office, said Fox had not posted bail, which was set at $100,000.

Fox resided in an apartment above Kelly's Sea Level, a popular bar in Rye.

CBS TV interviewed Frank Byrne, identifying him as one of Fox's Rye neighbors. Byrne said Fox's friends and family are devastated by the tragedy. The CBS2 story can be read by clicking here.

Fox has been on suicide watch at Westchester County Jail, according to News12. 

According to multiple reports, Fox called 911 after realizing she struck something along the roadway, and cooperated with police at the accident scene.
