Westchester County District Attorney Anthony Scarpino, Jr. announced on Thursday that Sincere Smith has been convicted of a felony count of second-degree assault after being found guilty of pistol-whipping his victim in New Rochelle on May 13 last year at a barbershop. His co-defendant, Philip Sutton, pleaded guilty to the same offense for his involvement in the same crime last month.

Smith, a New Rochelle resident, is also charged with three others for his involvement in the murder of Trevon Boswell on Washington Street on May 22 last year as part of a 12-hour crime spree in Westchester.

Smith, Eric Lee, Allen Copeland, Jr. and John Oquendo allegedly began their crime spree at approximately 3 a.m. on May 22 last year in New Rochelle when two men reported being robbed and pistol-whipped before their attackers took off in a taxi, police said.

Mount Vernon police said that a cell phone that was stolen in the process was tracked down using location-tracing software within the iPhone, and four suspects were approached by police on South 10th Avenue in the city.

Copeland, Lee and Smith all fled, but Oquendo was apprehended at the scene and a handgun was recovered. Following an intensive investigation, police tracked down the other three suspects, who have since been arraigned and remain remanded to Westchester County Jail.

Additionally, Smith has been charged separately with co-defendant Anthony Lopez for a robbery incident that took place on Feb. 12 in Ossining last year. If found guilty, he faces up to 25 years in prison.

Smith is due to be sentenced on the assault charge on April 3, when he will face up to seven years in prison.
