Westchester County District Attorney Anthony Scarpino Jr. announced on Friday the conviction of Mount Vernon resident James Brower, who was convicted on Thursday of second-degree burglary as a sexually motivated felony, forcible touching and stalking, a misdemeanor.
According to Scarpino, at approximately 3 p.m. on Oct. 12 last year, Brower began accosting his female victim near West 3rd Street and South 11th Avenue in Mount Vernon. Brower followed his victim, who was walking to a nearby deli, making sexually charged statements that “placed her in fear he would subject her to unwanted contact.”
When the woman attempted to ignore Brower and continue, he followed her, repeating his sexual advances and “forcibly slapping her buttocks,” Scarpino said. The woman, “fearful that (Brower) would follow through on continued threats of sexual advances,” proceeded to her home, where she told her husband of the incident.
Scarpino said that while they were talking, they startled by the appearance of Brower in the threshold of their bedroom, though he fled when he saw his victim’s husband, who chased him off and called the police. Brower was swiftly apprehended by officers from the Mount Vernon Police Department and arrested.
As a second violent felony offender, Brower will face up to 15 years in state prison and 20 years of post-release supervision when he is sentenced on Aug. 15.
