FISHKILL, N.Y. -- New York State Police from the Wappinger barracks arrested Marc A. Salivate 41, of White Plains, for aggravated driving while intoxicated under Leandra’s Law, on Saturday, Nov. 7, said police.
Police said that after stopping Salivate on Route 9 in Fishkill for erratic driving, he was found to be intoxicated, He was charged with aggravated DWI under Leandra’s Law due to the fact that his two children were in the vehicle at the time of the stop, police said.
Leandra's Law was enacted in the named of Leandra Rosado, an 11-year-old girl, killed on the Henry Hudson Parkway on Oct. 11, 2009 when her friend's mother, Carmen Huertas, flipped the car they were in while allegedly under the influence of alcohol. Six other children were also injured during the incident.
The law makes drunk driving an automatic felony on the first offense if a person age 15 or younger is a passenger inside the vehicle.
Salivate is schedule to appear before the Town of Fishkill Court on Nov. 18, at 9:00 a.m.
