NORTH CASTLE, N.Y. – North Castle real estate attorney Kevin Hymes has pleaded guilty to the theft of approximately $2 million. Hymess, of 3 Evergreen Road, was accused of taking the money over a period of 5 ½ years, according to the Westchester County District Attorney's Office.
Hymes was convicted and sentenced Monday in the Southern District of New York on conspiracy to commit bank and wire fraud charges. The case involved a $58 million mortgage fraud scheme.
Hymes was arrested by investigators from the Westchester County District Attorney’s office on June 27, 2012. He now faces a maximum of 15 years in prison, the district attorney's Office said. His sentence begins April 23.
Working out of an office in White Plains, Hymes defrauded multiple clients between January 2007 and June 2012 by making false representations during real estate closings.
In March 2010, he stole over $318,000 by concealing the date and time of a real estate closing and failing to forward the payment, Westchester County District Attorney's Office said.
Hymes performed similar actions between May 2010 and June 2010, stealing a $33,000 deposit from a prospective purchaser. He again stole deposits of $10,00 in November 2010 and $123,500 between March 2011 and April 2011.
Hymes additionally stole over $1.4 million in his role as a closing agent for several banks. In addition to his prison sentence, he has been disbarred from the practice of law.
