Edgemont resident Alan Brody is also alleging negligence in his suit over the 2015 tragedy that took the life of 49-year-old wife, Ellen, and killed five passengers on the Harlem Line commuter train, the lohud story said. He is claiming that the railroad crossing was unsafe.

The other victims were from Westchester and Danbury, Conn. More than a dozen other passengers were seriously injured.

Brody's suit also names the Metropolitan Transportation Authority and Steven Smalls, the train’s engineer, lohud reported.

Alan Brody recently told Daily Voice that he and his family has been able to cope because they are still inspired by the mother of three’s “larger-than-life presence.”

Ellen Brody, who worked in a Chappaqua jewelry store, was a “wonderful person” and “a joy to anyone who knew her,” her husband told the Daily Voice.
