In court documents made available Tuesday, prosecutors argue that Kennedy's case should be treated like any other first-time offender, according to Fox News.
In a motion filed in North Castle Town Court last month, Kennedy’s lawyers said she accidently took a sleeping pill on July 13, 2012 before she collided with a tractor-trailer on I-684.
Prosecutors said a trial should be held to determine Kennedy's intention of taking the pill.
Kennedy, one of the late Sen. Robert F. Kennedy's 11 children and the ex-wife of Gov. Andrew Cuomo, originally pleaded not guilty to the charge of driving while ability impaired and said she suffered from a "complex partial seizure" while driving. Results of a neurological test at Mount Sinai Medical Center showed the blackout was caused by a seizure, but toxicology tests revealed she had the prescription drug Ambien in her system at the time.
Kennedy's lawyer plans to respond to the motion later this month.
